Use of the website
By placing an order with The Garden Stuff Company you will be deemed to have read, understood and agreed to these Terms and Conditions. If you are unhappy with any aspect of these Terms & Conditions, then please email customerservices@thegardenstuffco.com before placing an order with us.
Every purchase you make via The Garden Stuff Company website shall be deemed performed in England. The use of the website and these Terms and Conditions shall be governed, construed and interpreted in accordance with English law and you agree to submit to the non-exclusive jurisdiction of the English Court.
The Garden Stuff Company reserves the right to:
- modify or withdraw, temporarily or permanently, this website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the website and/or
- change these Terms & Conditions from time to time, and your continued use of the website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Terms & Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the website.
We reserve the right to reject any offer to purchase by you at any time. We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure but, in the absence of negligence on our part, we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website.
Contract, Order Acceptance & Cancellation
The steps required to create the contract between you and The Garden Stuff Company are as follows
1. You place the order for your products on the website by adding them to the basket and completing the steps of the checkout process.
2. We will send to you an order acknowledgement email detailing the products you have ordered. This is not an order confirmation or an order acceptance from The Garden Stuff Company.
Order acceptance and the completion of the contract between you and us will take place on the despatch of the Products ordered to you unless we have notified you that we do not accept your order, or you have cancelled it before despatch.
We may not be able to accept your order or part of your order due to one of the following reasons
- The product you ordered is out of stock
- Authorisation of your payment failed
- We made a pricing or product description error
- You are not eligible to order from The Garden Stuff Company.
If there are any problems with your order, you will be contacted by a member of our Customer Services team.
If you change your mind about an order you have placed with us, please contact our Customer Services team as quickly as possible by emailing orders@thegardenstuffco.com.
Orders are normally processed immediately after you place the order, so we may have already packaged your order and made arrangements for it to be sent to you when you cancel it. If this is the case then we cannot always stop the order from being sent. Once you receive the order, you will have to return it to us.

Product Descriptions
Each product purchased is sold subject to its product description. We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the website as up to date as possible, the information including product descriptions appearing on this website at a particular time may not always reflect the position exactly at the moment you place an order.
Payment
All prices are correct at the time of entering the information onto the system. The total cost of your order is the price of the products ordered plus delivery, where applicable.
You confirm that the credit or debit card that is being used is yours. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.
Refusal of Transaction
We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any product from this Website whether or not that product has been sold; removing or editing any materials or content on the Website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.
To be eligible to purchase products on this Website and lawfully enter into and form contracts on this Website under English law you must:
- Register by providing your real name, phone number, e-mail address, payment details and other requested information
- Be over 18 years of age
- Stipulate a delivery address in the United Kingdom. Please note that PO box numbers, hotels and accommodation addresses are not acceptable
- Possess a valid credit or debit card issued by a bank acceptable to us
By making an offer to buy a product, you specifically authorise us to transmit information (including any updated information) or to obtain information about you from third parties from time to time, including but not limited to, your debit or credit card number or credit reports, to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions.
Collection/Delivery
We will offer you the first available date and time slot for delivery in your area. We request that you accept the earliest date offered for delivery. If the item you have ordered is not in stock and has a lead time, delivery time is not included in this lead time.
We only deliver through a ground floor or basement entrance and go up to a second floor level. We cannot deliver above this level unless there is suitable lift access. If you require a special delivery any extra charges are to be paid by you, the customer. We sell some large and heavy products that on health and safety grounds require more than a two man delivery - we will call you to advise you of any extra cost involved in delivering before your order is processed.
If we attempt to make a delivery on the delivery date/timeslot that you have accepted and no one is present to receive the goods and a repeat delivery is required, you will incur a repeat delivery charge, which must be paid prior to the redelivery, even if the original delivery was free of charge. This repeat delivery charge will also apply if you cancel an agreed delivery date/timeslot less than 2 working days prior to the agreed date.
If you are ordering multiple items, please be aware that we cannot guarantee that all items will be despatched together. Please note that deliveries will require a signatory present to accept the goods.
If your goods remain at our warehouse for more than four weeks, during which time you fail to accept delivery/redelivery (despite The Garden Stuff Company having contacted you to do so), you will incur storage charges. We also reserve the right to cancel your order and retain up to 50% of you order value.
FREE Delivery
We do not currently deliver to addresses outside the UK. Free delivery is only available to mainland UK addresses, however the following postcode areas are excluded from the free delivery offer:
BT, GY, JE, HS, IM, IV, KA27-88, PH17-44, PO, TR21-25, ZE
Additionally, where redelivery is required due to a signatory not being present on the pre-arranged delivery date or due to the above criteria for the delivery destination not being met, The Garden Stuff Company reserves the right to charge as required for additional delivery costs incurred.
Short Delivery, Defective Goods Or Damaged Goods
We strongly advise you to thoroughly check your goods upon receipt. To protect your interests, any claim concerning short delivery and/or damaged and/or defective goods found on delivery, or concerning damaged or defective goods found at a later date, must be notified as soon as possible to our customer services department. We do not accept any claims for damage caused by you the customer.
Large Items Measurements
The dimensions given are written for your guidance but additional allowance should potentially be made for the item’s dimensions when packaged. Before ordering, please ensure that there is adequate room to take the furniture through any doorways and windows, taking note of any restricted passageways, stairs and awkward turns.
Returns & Refunds
If you are unhappy with your goods you can return any item in its original condition and packaging, for any reason within 28 days of receipt of the goods for a replacement or a full refund.
All items must be returned to us before a refund or replacement is issued. If we have made a mistake in the order, we'll also refund the delivery charge.
We will notify you as soon as your refund/replacement has been issued to you. This will be within 7 days of us receiving the goods back from you. This does not affect your statutory rights as a consumer.
Steps to follow when returning an item
If for any reason you want to return an item, just follow these simple steps - it's easy. Please email returns@thegardenstuffco.com to request a return form quoting your order reference number. That form helps us to process your return as quickly as possible. Please state the reasons for the return on that form; it is very useful if you can provide as much detail in your comments as possible.
We strongly recommend you obtain a free 'Certificate of Posting' from the post office, as we will not accept responsibility for parcels lost in transit. For peace of mind you might want to send the goods Recorded Delivery, but we regret we cannot refund this charge.
Please send your returned items to the address specified on the return form.
Distance Selling Regulations
You have the right to cancel the contract at any time up to the end of seven working days after you receive the goods (see below). A working day is any day other than weekends and bank or other public holidays.
To exercise your right of cancellation, you must give written notice to The Garden Stuff Company by post or email, giving details of the goods ordered and (where appropriate) their delivery.
If you exercise your right of cancellation after the goods have been delivered to you, you will be responsible for returning the goods to The Garden Stuff Company at your own cost. You must take reasonable care to ensure the goods are not damaged in the meantime or in transit.
Once you have notified The Garden Stuff Company that you are cancelling the contract, The Garden Stuff Company will refund you within 30 days for any sum that has been paid by you or debited from your credit/debit card for the goods.
Please note:
If you are exchanging goods and the new item you want costs less than the one you have returned we will refund you the difference.
If you are exchanging goods and the new item you want costs more than the one you returned an additional payment is needed before the new item will be despatched.
Replacement items will be sent to you free of delivery charges.
Refunds for items bought as gifts can only be given to the original purchaser. If you decide to exchange an item the purchaser will be informed.
Indemnity
You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the Conditions by you or any other liabilities arising out of your use of this website, or the use by any other person accessing the website using your shopping account and/or your personal information.
The Garden Stuff Company's total liability for any claim howsoever arising shall not exceed the price of the goods supplied by The Garden Stuff Company to the customer, together with any postage costs incurred. The Garden Stuff Company shall not be liable for any consequential customer loss whether this arises from a breach of duty in contract or in any other way. This statement does not affect customers' statutory rights.
The Garden Stuff Company and The Garden Stuff Company’s owned names and or logos contained in this site are trademarks and or registered trademarks of The Garden Stuff Company. Other names on this site may be trademarks or registered trademarks of their respective owners.
Privacy & Security
The information we need and how we use it
If you buy something from us, we will require your name, a delivery address, the billing address, e-mail address, credit / debit card number and card expiry date. Without this information we will not be able to process your request or notify you of acceptance of your order.
A contact telephone number will also be required so that we may contact you urgently if there is a problem with your order. We may, unless you advise us otherwise pass this information to our couriers or other agents in case they need to contact you to arrange the processing or delivery of your order. We also maintain an order history of your purchases. This allows you and us to track your deliveries and review your past purchases. We may offer you a reward for purchases or make an offer we think you might like based on your order history.
We may also collect user information about where you are on the Internet (e.g. the URL you came from, IP address, domain types like .co.uk and .com), your browser type, the country and telephone area code where your computer is located, the pages of our website that were viewed during your visit, and any search terms that you entered on our website. We may collect this information even if you do not buy from us.
When you register with us, you can select whether you would like to be sent notification of special orders, promotions and other correspondence from us or selected third parties via email. If you would like to receive these notifications you must select the tick box on the registration page. If you leave the box unchecked you will not receive these notifications. If, in the past, you have chosen to be notified and you no longer wish to receive mailings from us please send an email to unsubscribe@thegardenstuffco.com and we will remove your email address from our records.
We treat all your personal information as confidential (although we reserve the right to disclose this information in the circumstances set out below). Our data collection and storage fully complies with UK and EU data protection legislation (such as the Telecommunications (Data Protection and Privacy) Regulations 1999 and the Directive on Privacy and Electronic Communications 2002). If we intend to transfer your information outside the EEA (European Economic Area) we will always obtain your consent first.
You should be aware that if we are requested by the police or any other regulatory or government authority investigating suspected illegal activities to provide your personal information and /or user information we are entitled do so.
What we do with your information
In addition to processing your order, we also maintain an order history of your purchases. This allows you and us to track your deliveries and review your past purchases. We may offer you a reward for purchases or make an offer we think you might like based on your order history.
Who else sees your information
We may have to disclose some of your information to service suppliers e.g. courier companies to help complete your order.
'Cookies'
Our site also uses 'cookies'; a cookie is a small text file which our website places on your computer's hard drive to store information about your shopping session and to identify your computer. Cookies cannot harm your machine in any way; you can see them as small text files inside your 'Temporary Internet Files' folder in Windows. Our cookies keep track of the items in your shopping basket and act as place markers when you move around the site. When you close your browser, our cookie will be deleted from your computer.

Liability
We cannot be held liable for any loss that you may suffer if a third party obtains unauthorised access to any data, including account details or details you provide us when accessing or ordering from this site, unless this can be proven at law to be due to our negligence.
Security
We guarantee that every online purchase you make from The Garden Stuff Company is a secure transaction. Our site uses the strongest commercially available level of encryption, 128-bit Secure Socket Layers (SSL). This ensures that your transactions are secure and your information cannot be hi-jacked or redirected to anyone but The Garden Stuff Company.
If your browser is capable of SSL, your sensitive information will automatically be encrypted before being sent over the Internet. (You don't however have to know in advance whether your browser does support secure transactions- if it doesn't you will not be able to complete the checkout process and the transaction will be cancelled automatically). All SSL capable browsers have a symbol (either a closed lock or a key), which indicates secure mode. In addition, you will be able to tell when you are in a secure area by the URL appearing in the address bar, which will change from HTTP to HTTPS.
When you submit your credit card details at the checkout, the information will be encrypted before leaving your computer. This information will remain encrypted until it is received by our secure server at which stage the information you have provided will be verified. A confirmation that your order has been received safely will be displayed on your screen a few moments later. You will also be e-mailed an order acknowledgment after further processing.
